Comcast® Responds to Programming Complaint Filed by beIN

In March, beIN filed a complaint to the Federal Communications Commission (FCC) claiming that Comcast® is in favor of NBC Universo and NBC Sports Network, giving them better penetration while being against beIN Sports networks. Comcast Corporation®, who offers arguably the best cable deals in the US, recently responded to the programming complaint by beIN, stating that it is very difficult for them to sell beIN’s English network and added that the Spanish language network of beIN usually achieves 90% penetration to significant audiences segments.

Comcast’s main point is to indicate that they do not treat beIN any different from all other big Multichannel Video Programming Distributors (MVPDs). Comcast® also told the FCC in their response that, “As beIN’s own data show, its networks are dominated by continental European soccer. This niche programming is plainly distinct from NBCSN’s diverse mix of marquee sports programming (e.g., NHL (including the Stanley Cup Playoffs), NASCAR, Olympics, Tour de France, English Premier League), and Universo’s general entertainment Spanish-language programming (e.g., Spanish language reality and scripted series, music programming, movies) with occasional sports content.”

beIN argued that Comcast® might not give them the right for authenticating Comcast® viewers who watch sports online through its website and application, although the Telco gives authentication to the soccer programming affiliated with Comcast®. The Telco giant stated that these allegations are “premature, overstated entirely speculative,” and added that through the connect platform of beIN, it was negotiating for authentication of the Comcast® subs with the programmer.

In their defense, beIN Sports USA stated that, “Comcast® is seeking to distract attention from its discriminatory practices by questioning the motives of the claim and relying on the same technical legal maneuvering they have historically used to undermine the protections established by the FCC to safeguard against discriminatory conduct.”

“Based on the answer, Comcast® would have the FCC believe that it should be allowed to discriminate against beIN Sports’ sports programming (in favor of its own NBC Sports and NBC Universo sports programming) by using data that is a direct consequence of its own discriminatory actions in consigning beIN Sports’ programming to less penetrated, more expensive tiers. In so arguing, Comcast® would effectively write the discrimination ban out of the rule books and undermine the FCC’s role in enforcing program carriage laws,” they further added.

“Our priority is, and continues to be, to provide the most compelling programming, coverage and analysis to our loyal viewers. We hope that we can arrive to a just resolution, that ultimately gives more Comcast® subscribers the opportunity to enjoy beIN Sports programming in HD and online through beIN Sports Connect,” beIN officials told the Commission.
